Rental Agreement & Terms for TLC Home Mobility Inc.

By renting equipment from TLC Home Mobility Inc., the customer agrees to the terms outlined below.

1 Agreement Overview

This Rental Agreement & Terms page governs the rental of equipment from TLC Home Mobility Inc. (“TLC”, “we”, “us”, or “our”). By renting equipment from TLC Home Mobility Inc., the customer (“Customer”, “you”, or “your”) agrees to be bound by this agreement and these terms.

2 Rental Equipment

TLC Home Mobility Inc. agrees to provide the rental equipment specified in the rental order, invoice, secure checkout confirmation, or rental agreement.

  • Hospital beds and related accessories
  • Air mattresses and pressure relief systems
  • Patient lifts, sit-to-stand lifts, and transfer equipment
  • Wheelchairs, transport chairs, walkers, rollators, and knee scooters
  • Bathroom safety equipment and other home mobility equipment

3 Rental Period

The rental period begins on the date equipment is delivered, picked up, or made available to the customer. Rental periods may be daily, weekly, or monthly depending on the equipment and rental option selected. Rental charges continue until equipment is returned to TLC Home Mobility Inc. or picked up by TLC. No refunds or credits are provided for early returns unless approved by TLC in writing.

4 Rental Extensions

Customers requiring equipment beyond the original rental term must contact TLC before the rental period expires. Rental extensions are subject to equipment availability and continued payment.

5 Equipment Return & Pickup

The customer remains responsible for rented equipment until pickup is completed by TLC Home Mobility Inc. or the equipment is returned to TLC and inspected. Equipment must be available at the agreed pickup time and should be reasonably clean, accessible, and ready for removal.

  • Missed pickup appointments or inaccessible equipment may result in additional pickup, rental, or administrative charges.
  • Customers should remove personal items from equipment before pickup.
  • Rental charges may continue until equipment is successfully picked up or returned.

6 Delivery and Pickup

Delivery and pickup fees may apply. The customer is responsible for providing safe access to the property and ensuring the delivery area is ready before the scheduled appointment.

  • Safe and clear access to the home, room, or facility must be provided.
  • Stairs, elevators, narrow hallways, parking restrictions, or other obstacles must be disclosed before delivery.
  • TLC may refuse delivery, setup, or pickup where conditions are unsafe or unsuitable.

7 Customer Responsibilities

The customer agrees to use the rented equipment only for its intended purpose and to follow applicable manufacturer instructions and safety guidance.

  • Use equipment safely and responsibly.
  • Prevent misuse, abuse, neglect, unauthorized use, or unsafe operation.
  • Keep equipment clean, dry, secure, and in a suitable environment.
  • Report damage, malfunction, loss, theft, or safety concerns immediately.

8 Equipment Inspection and Acceptance

Rental equipment is cleaned and sanitized between rentals using TLC Home Mobility procedures. Customers must inspect equipment upon delivery or pickup. Any concerns regarding damage, missing parts, cleanliness, or malfunction must be reported to TLC immediately. Continued use of the equipment constitutes acceptance of the equipment’s condition.

9 Weight Capacity and Equipment Suitability

The customer acknowledges responsibility for ensuring the equipment is appropriate for the intended user, care environment, and intended use. The customer is responsible for ensuring the user’s weight does not exceed the manufacturer’s rated capacity.

TLC Home Mobility Inc. does not provide medical advice, diagnosis, treatment recommendations, clinical assessments, or professional healthcare services. Customers should consult qualified healthcare professionals regarding equipment suitability, medical needs, and safe care practices.

11 Loss, Theft, Damage, and Misuse

The customer is responsible for all loss, theft, destruction, misuse, or damage occurring during the rental period beyond normal wear and tear. Repair or replacement costs may be charged to the customer. The customer remains responsible for the equipment until it is returned to TLC and inspected by TLC staff.

12 Unauthorized Repairs or Modifications

Customers shall not repair, modify, disassemble, alter, or permit any third party to repair or modify rental equipment without written authorization from TLC Home Mobility Inc.

13 Payment Authorization

By completing a rental transaction, the customer authorizes TLC Home Mobility Inc. to process applicable charges related to rental fees, delivery fees, pickup fees, approved add-ons, damage charges, loss or replacement charges, and outstanding balances.

14 Collection Costs

Customers agree to pay reasonable collection costs, administrative costs, legal fees, and expenses incurred in recovering overdue balances or unpaid charges.

15 Limitation of Liability

To the maximum extent permitted by law, TLC Home Mobility Inc. shall not be liable for indirect, consequential, incidental, special, punitive, or economic damages, including loss of income, loss of profits, loss of use, or delays in delivery, arising from the rental, use, misuse, inability to use, condition, malfunction, or performance of rented equipment. TLC’s total liability shall not exceed the rental fees paid by the customer for the equipment involved.

16 Indemnification

The customer agrees to indemnify and hold harmless TLC Home Mobility Inc., its directors, officers, employees, contractors, and representatives from claims, damages, liabilities, costs, and expenses arising from use of rented equipment, improper operation, customer negligence, third-party claims, or failure to follow these terms.

17 Force Majeure

TLC Home Mobility Inc. shall not be liable for delays or failure to perform due to circumstances beyond its reasonable control, including severe weather, natural disasters, power outages, transportation disruptions, supplier shortages, labour disruptions, government actions, or other events outside TLC’s reasonable control.

18 Privacy and Communications

Customer information is collected, stored, and used in accordance with TLC Home Mobility Inc.’s Privacy Policy. By renting equipment, customers consent to communications related to rental orders, delivery, pickup, billing, customer service, and rental support.

19 Governing Law

This Rental Agreement & Terms page shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein. Any dispute shall be subject to the jurisdiction of the courts of Ontario.

Patient Lifts

Lifts, Slings & Transfers

For patient lifts, sit-to-stand lifts, slings, transfer aids, and related equipment, users and caregivers are responsible for safe operation. Proper training is recommended before use. Only compatible slings and accessories approved by the manufacturer may be used.

Hospital Beds

Beds, Rails & Entrapment Risk

Hospital beds and side rails may present entrapment risks. Mattresses, rails, and accessories must be compatible with the bed system. Users and caregivers are responsible for ongoing monitoring and safe operation.

Air Mattresses

Pressure Relief Disclaimer

Alternating pressure mattresses and pressure relief systems are intended to assist in pressure management. TLC does not guarantee prevention, treatment, or healing of pressure injuries, pressure ulcers, or bed sores.
